At what point in time is coverage determined? Resident Policyowner, Certificateholder or Contract Holder
Residency is determined at the time the insurer is deemed to be insolvent (the "date of insolvency").
If a person satisfies the residency test as of the date of insolvency, he or she (and the beneficiaries, assignees or payees under such policy) continues to be covered (until the limits under the policy or the Act have been met) regardless of where he or she may later reside.
Nonresident Policyowner, Certificateholder or Contract Holder
Nonresident policyowners, certificateholders and contract holders (and their beneficiaries, assigness and payees) are only covered so long as all four conditions to coverage (specified in 4 above) continue to be met. If one or more of the conditions is subsequently not met (for example, residency is no longer in a state in which the insurer never held a license), coverage is terminated. |
